Role Purpose:

 

Employee Relations (ER) involves work that is focused on supporting promoting and facilitating fair and productive employee/employer relationships. The role of ER involves working with the respective Subject Matter Experts (SMEs) to review / create ER or ER related policies providing guidance / advice on procedures and policies on matters related to ER or can give rise to ER implications (e.g. workplace conflicts complaints performance appraisal disputes absence management disciplinary actions/consequence management exit management/business re-structuring) leading/managing internal investigations on complicated matters arising from PCC (personal misconduct) and employee grievances or advising the HR Advisory team on management of the less complicated PCC and grievance cases overseeing cases involving the Ministry of Labour provide various reports on management information relating to PCC and grievance analytics to identify trends and areas of significant people / HR risks.

 

Highlights of this role will be:

 

Maintain high level of integrity & confidentiality at all times

Lead and manage internal investigations on complicated matters arising from PCC employee grievances whistleblowing cases and other workplace issues in line with HSBC protocols

Provision of advice and guidance on employee relations activity including informal and formal internal disputes e.g. Disciplinary and Grievances

Provision of advice and guidance on reorganization & restructuring activity including redundancies insourcing outsourcing employee terms and interpretation of policy

Provision of advice and guidance on conduct considerations related to requests to rehire former employees

Provision of advice and guidance on compulsory termination of employment

Negotiate exits and settlement / exit agreements and waivers and advise on involuntary terminations

Create review and refine policies and operating procedures. Embed policies and evaluate policy effectiveness

Support various reporting (e.g. for People Committee, Risk Committee Workplace Harassment Forum … etc)

Participate in HR projects as required

Facilitate coaching for HRA and HRCs in areas of employee relations practices.

Effectively apply group policies into local processes and policies.

Stakeholder management

Provide competent and consistent advice to the businesses with regards to ER related matters

Engage with business to provide ER related input on the Monthly or quarterly MIs and other procedures

Engage with ER colleagues in the broader Regional ER team and support on cross border investigations if needed.

 

Guidance and Authority:

 

The jobholder has considerable independence in interpreting and applying HR policies and principles to complex people issues influencing senior and executive managers accordingly:

 

Providing consistent business focused employee relations advice and guidance to line managers in respect of complex ER issues and to members of the ER and broader HR teams.

Undertaking hearings under the banks Grievance/ bullying and harassment procedures

Is the decision maker on complex investigations on discrimination harassment and bullying and working with the business in order to provide a sustained solution which meets business needs and is in line with country law and Banks policy.

 

 

Principal Accountabilities:

 

Impact on the Business:

 

Undertake disciplinary hearings under the banks disciplinary and grievance procedures ensuring that decisions made comply with both internal and external spirit of the procedures to mitigate the risk of potential litigation and or cost impact.

Be up to date with employment laws to ensure HSBC management and employees are in compliance.

Work in partnership with Employment Legal to provide guidance to key stakeholders on any employment related litigation. Ensure that all newly created and existing employment policies and procedures do anticipate and meet the legal requirements and Market practice.

Supporting line management by providing advice guidance and direction in relation to employee relations and employment law to make the decisions for all ER related matters.

Demonstrate the zero tolerance standers and ensuring that management apply this fairly and consistently.

HR Point of contact for decision making and advice on any ER escalations and is responsible for Managing case /projects in accordance with banks policy /country law.

 

Leadership & Teamwork:

 

Managing ER cases this includes case management litigations management capabilities disciplinary performance issues etc.

Oversee that all policies are aligned to country law.

Ensure that HSBC values are demonstrated at all times to both internal and external clients

Proactively shares knowledge with colleagues and customers/stakeholders to support and improve ER understanding and capabilities.

Seeks appropriate input and guidance on queries or issues that are outside own knowledge/experience.

 

Operational Effectiveness & Control:

 

Lead on employee relations aspects by Identify and analyse the implications of any developments and proposals arising from local legislation and implement changes in banks policies and procedures to be aligned with county law.

Decide on the appropriate / best practice process and mechanisms and communicate the same to the stakeholders and wider HR team members.

Maintain and report of all personal conduct cases with detailed analyses.

Early and proactive escalation of issues when required with a solutions focused mind-set.

Contribute to the implementation and oversight of HR policy and frameworks which ensure quality effective risk management and regulatory compliance.

Continually reassess the operational risks associated with the role and inherent in ER taking account of changing economic or market conditions legal and regulatory requirements operating procedures and practices organizational structure and the impact of new technology.

 

Qualifications:

 

Project management

Bi-Lingual (Arabic English) – Excellent in both spoken and written. Strong investigation and report writing skills

Well-developed organizational skills and strong attention to detail.

Flexibility and ability to multi-task.

Experience with country law and labor relations within Egypt and good knowledge of Middle East culture

Demonstrable experience of managing contentious people issues effectively with a high level of emotional intelligence skills.

Proactive approach to work. Ability to exercise sound judgment and creativity in identifying options and risks in order to make the right decisions around issues that have a significant adverse effect on the organization.

Ability to communicate effectively with people at all levels

Analysis and problem solving skills

Interpersonal and communication skills written and verbal.

Proven ability to work well under pressure within demanding timescales.

Ability to approach issues strategically assess risk and anticipating consequences and develop creative solutions to problems within the framework or bank procedures and country law

Experience of working within a complex organizational structure and ability to successfully navigate that structure.

The ability to rapidly develop a detailed knowledge of ER practices and procedures
